Terms of Service

Acceptance of terms

These Terms of Service ("Terms") govern your use of AuctionPage, operated by EPage, Inc. ("EPage," "we," "us," or "our"), a California corporation based in Redondo Beach, CA. By creating an account or using any part of the platform you agree to these Terms. If you do not agree, do not use AuctionPage.

Accounts

You must be 18 years of age or older to create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at epage@epage.com if you suspect unauthorized access.

You may not create more than one account or transfer your account to another person without our written consent.

NPO registration

Nonprofit organizations must apply and be approved before they can receive proceeds through AuctionPage. By applying, the NPO representative certifies that the organization is a registered 501(c)(3) (or equivalent) entity in good standing and that they are authorized to bind the organization.

Approved NPOs must maintain an active Stripe Connect account to receive monthly transfers. EPage reserves the right to suspend or terminate an NPO's access if information provided during registration is found to be inaccurate.

Listing items

Sellers may list items for auction subject to the following conditions:

  • Items must be accurately described with clear photos
  • Sellers must own the item or have the right to sell it
  • Sellers must designate a donation percentage of at least 50% of net proceeds to an approved NPO
  • Sellers must specify a pickup zip code or indicate willingness to ship
  • Listings must comply with all applicable laws

EPage reserves the right to remove any listing that violates these Terms or that we deem inappropriate, without prior notice.

Bidding

A bid is a binding commitment to purchase the item at that price if you win. Bids may not be retracted after placement except in exceptional circumstances at EPage's sole discretion.

AuctionPage supports proxy bidding: you may set a maximum bid and the system will automatically increment on your behalf up to that amount. The displayed bid is always the current leading bid, not your maximum.

When an auction closes, the highest bidder is obligated to complete the purchase. Failure to pay may result in account suspension.

Fees & payouts

AuctionPage charges a single all-inclusive fee of 13% of the final sale price — covering the 10% platform fee and 3% Stripe payment processing. There are no listing fees, monthly fees, or other charges.

How proceeds are distributed

After the 13% fee is deducted, the remaining 87% of the sale price is split between the seller and the NPO pool based on the seller's chosen donation percentage (minimum 50%).

Dual NPO split

The NPO pool is split 50/50 between the listing NPO (the NPO associated with the seller's listing) and the bidder NPO (the NPO through whose site or link the winning bidder participated). If both are the same organization, that NPO receives the full pool.

Payout schedule

  • Sellers are paid after the buyer confirms receipt of the item, or automatically 7 days after the tracking information shows delivery — whichever comes first.
  • NPOs receive a monthly transfer on the 1st of each month via Stripe Connect, covering all proceeds from closed auctions in the prior month.

Payments

All payments are processed by Stripe. By purchasing on AuctionPage you agree to Stripe's Terms of Service. Winning bidders must pay within 48 hours of auction close. Failure to pay may result in account suspension and the item being re-listed.

All transactions are in US dollars. EPage, Inc. is the merchant of record for all purchases.

Shipping & pickup

Sellers are responsible for shipping items to winning bidders in a timely manner (within 5 business days of receiving payment unless otherwise stated in the listing). Sellers must provide tracking information.

For pickup-only items, buyer and seller coordinate pickup directly. EPage is not responsible for disputes arising from in-person pickup arrangements.

If an item arrives damaged or significantly not as described, buyers should contact us at epage@epage.com within 5 days of receipt.

Messaging

AuctionPage provides a platform messaging system for transaction-related communication between buyers, sellers, and NPOs. By using this feature you agree to the following:

  • Messages must relate to a legitimate transaction or inquiry on the platform. Spam, chain messages, and unsolicited bulk contact are prohibited.
  • You may not use platform messages to harass, threaten, or abuse other users, or to contact a user who has asked you to stop.
  • You may not solicit off-platform payment, share external contact information, or otherwise attempt to circumvent AuctionPage's systems through messaging.
  • You may not impersonate EPage staff or another user in messages.
  • Consent to review. You acknowledge that EPage may access and review platform messages for the purpose of dispute resolution, fraud detection, and enforcement of these Terms and the Community Standards. Message content may be disclosed to law enforcement if required by law or if the content involves suspected illegal activity.

Violation of these messaging rules may result in restriction or termination of your account.

Prohibited conduct

You may not use AuctionPage to:

  • List counterfeit, stolen, or illegal items
  • List items prohibited by federal, state, or local law
  • Shill bid (bid on your own items through another account)
  • Manipulate auction outcomes
  • Harass, threaten, defraud, or spam other users — including via the platform messaging system
  • Attempt to circumvent fees or payment processing
  • Scrape, copy, or redistribute platform content without permission
  • Interfere with platform operations or security

Violation of these prohibitions may result in immediate account termination and, where appropriate, referral to law enforcement.

Disclaimers

AuctionPage is provided "as is" and "as available" without warranties of any kind, express or implied. EPage does not warrant that the platform will be uninterrupted, error-free, or free of viruses. We are not responsible for the accuracy of item descriptions provided by sellers.

EPage is a marketplace and is not a party to transactions between buyers and sellers. We do not guarantee item quality, authenticity, or delivery.

Limitation of liability

To the fullest extent permitted by law, EPage, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability to you for any claim arising out of or relating to these Terms or your use of AuctionPage shall not exceed the fees paid by you to EPage in the 12 months preceding the claim.

Disputes between users

Disputes between buyers and sellers should first be reported to EPage at epage@epage.com. We will attempt to mediate but are not obligated to resolve disputes and make no guarantees about outcomes. EPage's decision on platform-level matters (account access, fee calculations) is final.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal action arising from these Terms shall be brought in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and update the effective date. Continued use of AuctionPage after changes take effect constitutes acceptance of the revised Terms. For material changes we will notify registered users by email at least 14 days in advance.
